PlotCipher complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. §512. This page describes how to send a notice of copyright infringement and how to send a counter-notification.

Sending a Notice of Infringement

To report content on the Service that you believe infringes your copyright, send a written notice to our Designated Agent (above) containing all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works);
  3. Identification of the material claimed to be infringing, including the URL or sufficient detail to allow us to locate it;
  4. Your contact information (name, address, telephone number, and email address);
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Notices that do not contain substantially all of the elements above may not be actionable under §512. Knowingly materially misrepresenting that material is infringing may subject you to liability under §512(f).

Our Response

If we receive a valid notice we will:

  • Promptly remove or disable access to the allegedly infringing material;
  • Take reasonable steps to notify the user who posted the material;
  • Maintain a record of the notice and our response.

Counter-Notification

If you believe content you posted was removed in error, you may send a counter-notification to the Designated Agent containing:

  1. Your physical or electronic signature;
  2. Identification of the material removed and the location at which it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the US, of the United States District Court for the Northern District of Texas), and that you will accept service of process from the notifying party or its agent.

On receipt of a valid counter-notification, we will forward it to the notifying party. If we do not receive notice within 10-14 business days that the notifying party has filed a court action, we may restore the material.

Repeat Infringer Policy

We will terminate accounts of users who are determined, in appropriate circumstances, to be repeat copyright infringers, consistent with §512(i).
